‘Walking Dead’ Showrunner Glen Mazzara Leaving






NEW YORK (TheWrap.com) – Glen Mazzara, who led AMC‘s “The Walking Dead” to ratings highs after the exit of Frank Darabont, is leaving the show.


The announcement came with the unsurprising news of a fourth-season pickup for the series. It continues AMC’s rocky record with its showrunners, but the network said the decision was mutual.






While AMC has clashed with showrunners before over money, a person familiar with the situation told TheWrap that this time the issue is “100 percent not about money or contracts.”


Rather, it is about a difference of opinion over where the show should go in the fourth season and beyond. It involves AMC, Mazzara and the show’s writers and producers, who include Robert Kirkman, creator of the comics that provide the basis of the series.


Kirkman might be the fans’ choice to take over as showrunner, given that most of its characters were born on his pages. But he also has a busy career writing comics and novels.


In a statement, Kirkman said he believes Mazzara and AMC came to the decision “in the best interest of the future of the show.”


In an interview with TheWrap in October, Mazzara said he would love to remain with the show until the end, “if AMC and the fans would have me.”


“I would love to be the guy shutting the lights off,” he said at the time.


It didn’t work out that way, even though Mazzara has made “The Walking Dead” this season’s top-rated drama — even beating network shows. It also has a legitimate shot at ending the season as TV’s top scripted show overall.


“Both parties acknowledge that there is a difference of opinion about where the show should go moving forward, and conclude that it is best to part ways,” AMC said in a statement.


AMC also said the decision is “amicable” and that Mazzara will remain showrunner for the remainder of the third season, which resumes airing in February. The episodes have already been filmed, and Mazzara will oversee postproduction.


He is also looking for his next project.


“My time as showrunner on ‘The Walking Dead’ has been an amazing experience, but after I finish season 3, it’s time to move on,” said Mazzara. “I have told the stories I wanted to tell and connected with our fans on a level that I never imagined. It doesn’t get much better than that. Thank you to everyone who has been a part of this journey.”


Mazzara took over the show after Darabont parted ways with it after its first season. Darabont was just one of several showrunners to have issues with AMC.


Jason Horwitch left “Rubicon” during its lone season. The third season of “Hell on Wheels” was briefly put on hold last month when showrunner John Shiban left.


“Mad Men” creator Matthew Weiner nearly walked from the show during a contract dispute last year. And “Breaking Bad” briefly looked into leaving AMC before creator Vince Gilligan’s contract was renewed.


Kirkman’s full statement included his thanks to Mazzara and the show’s fans.


“I am in full support of both AMC and Glen Mazzara in the decision they have come to and believe the parties came to this decision in the best interest of the future of the show,” Kirkman said. “I thank Glen for his hard work and appreciate his many contributions to ‘The Walking Dead’ and look forward to working with him as we complete post production on Season 3. I am also excited to begin work on another spectacular season of this show that I know means so much to so many people. This show has always been the result of a wide range of extremely talented men and women working tirelessly to produce their best work collectively. I believe the future is bright for ‘The Walking Dead.’ Thank you to the fans for your continued support.”


Executive producer Gale Anne Hurd also expressed her thanks.


“I am appreciative and grateful to Glen for his hard work on ‘The Walking Dead,’” she wrote. “I am supportive of AMC and Glen’s decision and know that the series is in great hands with one of the most talented and dedicated casts and crews in the business. I look forward to the show’s continued success.”

Borrowing grows more than expected









ONS chief economist Joe Grice: “There are straws in the wind that look promising”



The government had to borrow slightly more than expected in November.


It borrowed £17.5bn, £1.2bn higher than a year earlier, official figures show. Economists had predicted borrowing would fall slightly to about £16bn.


However, the Office for National Statistics said a 0.1% growth in the all-important services sector of the economy was “promising”.


It also revised down its estimate for growth between July and September to 0.9% from 1%.


The UK’s official statistics authority regularly revises its data on the value of the output of the economy as more information is collected from businesses.


Economists were divided as to what the different figures said about the state of the UK economy.


“All in all, the UK appears to be ending 2012 not in particularly great shape,” said James Knightly from ING.


However, for Alan Clarke from Scotiabank, the growth in services “makes it all the more likely that the UK did not slip into a triple-dip recession at the end of the year”.


The Bank of England said earlier this week that it thought the UK economy would contract again in the last three months of the year following the strong growth between July and September, when the economy received a boost from Olympic ticket sales.

‘Significant’ investment


The services sector grew 1.2% over the period and “held on” to those gains in October, the Office for National Statistics said.


Joe Grice, chief economist at the ONS, described the service sector gains as “promising straws in the wind” for the UK economy.


He also described a £1.1bn rise in business investment to £31.5bn as “significant”.


But the economy as whole still remains 3% below its pre-recession 2008 peak, he said.


Meanwhile consumer confidence remains volatile, according to a survey by research firm GfK on Friday showing a “dramatic” fall in confidence in December, contrasting strongly with an equally sharp rise in November.

The bigger-than-expected increase in government borrowing adds to the problems faced by Chancellor George Osborne as he struggles to reduce public borrowing in the face of a stuttering economy.


November’s figure takes total borrowing so far this financial year to £92.7bn, £8.3bn more than the same period in 2011.


Danny Alexander, Chief Secretary to the Treasury said: “These figures reflect the fact that this country continues to be on a hard and difficult road back to economic prosperity.


“We’re making real progress getting public spending down; we’ve reduced the deficit by a quarter over the last couple of years and a million jobs have been created in the private sector.”


“But these figures today on borrowing and on growth reflect the fact that this country continues to face tough economic challenges, and that will continue to be the main priority for the coalition as we go into the new year.”


Rachel Reeves MP, Labour’s shadow chief secretary to the Treasury, said: “For all the chancellor’s smoke and mirrors in the autumn statement, these figures show that borrowing is rising and is up by almost 10% so far this year.


“The failure of David Cameron and George Osborne’s policies on jobs and growth means they are now even failing on the one test they set themselves – to get the deficit and debt down.”

Showrooming little threat to clothiers in ho-hum holidays






Chicago (Reuters) – In retail, showrooming has not hit shirts yet.


Showrooming, the retail term for shoppers who try a product, then buy it cheaper on Amazon.com or other websites, has driven retailers to the point of hiding barcodes, improving their own websites and coming up with methods to get people to complete their purchase in the store.






But brand-name clothing retailers have an advantage over companies that sell items you can buy anywhere, like televisions and home goods.


Specialty apparel retailers are some of the least affected by showrooming since the more exclusive the product is, the harder it is to showroom,” said Joel Bines, managing director of the retail practice at advisory firm AlixPartners.


That, in turn, has helped retailers like Gap Inc and Lululemon Athletica Inc find favor with investors.


A survey of 2,010 adults conducted by AlixPartners showed consumers who shop for apparel were among the least likely (35 percent) to go to other websites after they liked an item at a store, compared with 42 percent of electronics shoppers and 41 percent of those looking for accessories like watches and jewelry.


“If you look at some of the most successful (clothes) companies in the past few years, they are those that have that moat around them,” said hedge fund manager Shawn Kravetz, who runs Esplanade Capital in Boston.


He cites yogawear maker Lululemon and Gap as good examples of how it can help to have clothes that are not sold elsewhere.


If a shopper wants to buy a Banana Republic or Nordstrom shirt from the latest season, they have to buy it either from their stores or online shop.


Discount retailers like Zappos, Amazon and others stock brand-name products, but the merchandise is often not from the current season or limited in colors and sizes.


“I don’t need to see if a television fits my body shape when I buy a TV,” said Joe Megibow, senior vice president of omni-channel e-commerce at American Eagle Outfitters. The teen clothes retailer has seen better sales than its peers over the past year.


“I can get a sense of the TV and I’m good. Clothing is different. Does it fit me, is it my style, do I like the quality of the material and how it is put together. There’s so much more with apparel that matters,” he said.


That is the part of the reason, analysts say, why online-only clothing companies like Bonobos and Gap’s Piperlime have started opening brick-and-mortar stores or tied up with retailers to sell their products in physical locations.


Choice and easy availability are the two most important aspects of shopping, especially during a holiday season that has lost steam after what looked like strong Thanksgiving sales.


Estelle Tran, an “impulsive” shopper in her twenties, agreed.


“If I want to buy books, tech items, DVDs, I would definitely buy online. For clothes, I would rather (visit stores) as it is also a fun experience to try on clothes,” said the Chicago-based finance auditor.


Tran said she would definitely check prices online if she was spending more than $ 100.


Luxury and high-priced items can be more susceptible to showrooming, because pricing is what drives the behavior, said Marshal Cohen, chief economist at the consultancy NPD Group.


“With electronics and certain consumer goods it is very easy to compare specific brands across multiple websites. But (showrooming is) happening and it will be growing. If a (clothes) retailer isn’t taking it seriously, they are going to fall behind,” said Bolette Andersen, principal in KPMG’s retail industry practice.


ROOM TO GROW


Some investors are betting on apparel stocks because of their relative insulation from the threat of showrooming.


While the S&P Apparel Index has returned a sizzling 27.71 percent year to date, according to Reuters data, far outperforming the S&P 500, which is up 14.80 percent, more gains may be coming.


“We still think there’s plenty of room to grow,” said Brian Peery, co-portfolio manager at Hennessy Funds. Its growth fund, heavily weighted in apparel and consumer discretionary goods shares, is up 30 percent over the year.


“As we look into the sector 12-18 months, we continue to buy the discretionary area. Two of our heaviest investments would be Foot Locker Inc and TJX Companies Inc,” he said.


Discount chains like TJX and Ross Stores, which sell branded clothes at low prices, have benefited from the surge in bargain-seeking shoppers.


Even the stocks of retailers like Gap and American Eagle that have staged or are staging turnarounds have gotten a good boost over the year. Gap has soared 69 percent and American Eagle is up 31 percent.


R. Shawn Neville, president of Avery Dennison retail branding and information solutions, said another reason that apparel and to a broader extent other consumer discretionary stocks do well is because of their sustainability.


“In uncertain times, investors look towards market segments that have strong underlying demand which are more stable, like the apparel industry,” Neville said.


Moreover, in times of economic uncertainty, shoppers can still afford clothes and shoes, as opposed to a new car, home, or expensive vacations, helping apparel stocks do well, he said.


“Though Amazon is clearly stealing some share in various categories, clothes retailers, say Abercrombie & Fitch isn’t going anywhere. They’re not being run out of the shopping mall,” said Esplanade’s Kravetz.

Analysis: Apple’s swoon exposes risk lurking in mutual funds






NEW YORK (Reuters) – The nearly 28 percent decline in shares of Apple Inc since mid-September isn’t just painful to individual shareholders. It’s also being felt by investors who chased hot mutual funds that loaded up on Apple as the stock raced to a record $ 705 per share.


Apple makes up 10 percent or more of assets in 117 out of the 1,119 funds that own its shares, according to data from Lipper, a Thomson Reuters company. Those big stakes have contributed positively to each fund’s annual performance to date, with Apple still up about 32 percent for the year. It was trading at $ 527.73 soon after the opening on Friday.






But that year-to-date outcome may not accurately reflect the performance of the funds for individual investors. All told, approximately $ 4.5 billion has been added to funds with overweight stakes in Apple this year, according to Morningstar data. The majority of these dollars were invested after March and after Apple first exceeded $ 600 per share – meaning many investors have been riding down with the decline.


The $ 302 million Matthew 25 fund, for instance, holds 17.4 percent of its assets in Apple, according to Lipper. The fund’s 31.9 percent gain through Thursday makes it one of the top performing funds for the year.


Most of its Apple shares were bought years ago at a bargain basement price of about $ 125 per share. But $ 158.9 million of the fund’s assets – or 53 percent – were invested after the end of March, when Apple was trading near $ 615 per share, according to Morningstar data.


For those investors that bought after March, all that concentration in Apple hasn’t led to a stellar gain but rather a drag on the portfolio. Someone who invested in Matthew 25 in early April has seen the value of the fund’s Apple stake fall about 19 percent, while someone who invested at the beginning of September has watched that outsized Apple stake drop 27.2 percent.


In turn, the majority of the fund’s investors have reaped a much more modest performance than its year-end numbers suggest. Since the end of March, the fund has gained 6.7 percent, according to Morningstar data, far less than its 31 percent year-to-date gain and about two percentage points more than the benchmark Standard & Poor’s 500 index.


Since, September the fund is down nearly 3 percent through Thursday’s close, compared with a 1.1 percent decline in the S&P 500 in that period.


The impact of Apple’s falling stock price shows some of the drawbacks of portfolio concentration, experts say. These stakes can leave the funds overexposed to the ups and downs of one company – counter to what most mutual funds are supposed to do for investors.


“Any time you get over 10 percent of the portfolio in one company it’s a red flag,” said Michel Herbst, director of active fund research at Morningstar. Many fund managers do have risk management rules that prevent them from devoting more than 5 percent to 6 percent of their portfolio to any one stock, he said.


Then again, some funds purposely invest in just a few stocks. Mark Mulholland, the portfolio manager of the Matthew 25 fund, said that taking concentrated positions in companies is the only way to beat an index over longer periods of time.


‘RIGHT-SIZING’ PORTFOLIOS


Along with concerns about iPhone sales in China and tax-motivated selling among people who want to avoid potentially higher capital gains taxes in 2013, the wide fund ownership of Apple may be a factor in the size of the stock’s recent declines, fund managers said. In addition, with so many funds already heavily invested in the high-priced stock, there may be fewer marginal buyers available to push prices up again when shares begin to dip.


“The stock didn’t go from $ 700 to $ 520 because people didn’t like the new iPad. It’s become a favorite short of hedge funds because they know they can get in on this,” said Mark Spellman, a portfolio manager of the $ 300 million Value Line Income and Growth fund with a small position in Apple.


Short interest in the stock rose to 20.6 million shares at the end of November from 15.1 million shares at the end of September, according to Nasdaq.


“Some of my competitors have 12 percent of their assets in Apple, which I think is ludicrous”, said Spellman, who said the company is no longer trading on its fundamentals.


Sandy Villere, who has a 2.5 percent weighting of Apple in his $ 276 million Villere Balanced fund, said that some mutual fund managers are selling shares because of the over-weighting.


“Right now many people who did take huge overweight positions are right-sizing their portfolios to get it in line with their regular weightings,” he said.


Still, some bullish investors see the stock’s recent declines as a buying opportunity.


Mulholland, the Matthew 25 portfolio manager, continues to say that shares should be priced at over $ 1,000 per share based on his valuation of the company at 10 times enterprise value divided by earnings before interest, taxes, depreciation and amortization (EBITDA). Apple trades at about 7 times that figure now.


Wall Street analysts’ average price target as of Thursday is $ 742.56, according to Thomson Reuters data. But Mulholland is happy to be more bullish than his peers.


“I’m glad that I’m able to get it at these prices,” he said.

“Les Miserables” movie relies on close-ups for emotional punch






NEW YORK (Reuters) – For British director Tom Hooper, the key to turning “Les Miserables” from the wildly popular stage musical to a cinematic experience both sweeping and intimate, was all in the close-up.


The stage musical has left audiences around the world wiping away tears with its themes of justice, redemption and romantic and familial love. So bringing it to life on screen for fans and filmgoers was “hugely daunting,” Hooper says.






Still, the Oscar-winning director of “The King’s Speech,” was ambitious, wanting to offer even more of the “intense emotional experience” that has kept fans returning to various stage productions since “Les Miserables” made its English language debut 27 years ago.


“I felt very aware of the fact that so many millions of people hold this close to their hearts and would probably sit in the cinemas in complete fear,” Hooper told reporters about his big screen take on the tale of French revolutionaries rising up against powerful forces.


Movie stars Hugh Jackman, Russell Crowe and Anne Hathaway were all put through an intense audition and rehearsal process, to make sure they could sing take after take, live, with cameras positioned right in their face.


It also features a large ensemble including Amanda Seyfried and Eddie Redmayne, as well as Sacha Baron Cohen and Helena Bonham Carter who lead the comic relief song, “Master of the House.”


“I thought the great weapon in my arsenal was the close up, because the one thing on stage that you can’t enjoy is the detail of what is going on in people’s faces as they are singing,” Hooper said. “I felt (that) having to do a meditation on the human face was by far the best way to bring out the emotion of the songs.”


That tactic may or may not have paid off for a movie that is seen as one of the front runners for Oscar awards in February. Early screenings of the film that opens on Christmas Day have moved some audiences. Critics have praised the performances, but given the movie as a whole less than top marks.


The movie reunites the same team that worked on the original musical, including French composer Claude-Michel Schonberg, lyricist Alain Boublil, and English language adapter Herbert Kretzmer. It adds one original song to the existing show, which includes the well-known “I Dreamed a Dream”.


Jackman plays petty thief Jean Valjean, the protagonist of the story based on French writer Victor Hugo’s epic 1862 historical novel “Les Miserables.” Valjean transforms himself into a respected businessman but struggles for decades to escape the clutches of his nemesis, police inspector Javert (Russell Crowe), and along the way encounters factory worker Fantine (Anne Hathaway).


TIMELY MESSAGE


Inspired by films such as 1991′s “The Commitments,” singing was filmed live rather than later recorded in a studio to give the movie a more authentic feel.


Hathaway lost 25 pounds (11.3 kg) for the role and cut her long brown hair. She spent six months perfecting the task of crying and singing at the same time for “I Dreamed a Dream” and is a hot favorite for a best supporting actress Oscar.


In a twist of fate, Hooper had initially seen Hathaway singing to Jackman a boisterous version of the “Les Miserables” song “On My Own” at the 2011 Academy Awards ceremony, just when he was trying to decide whether to direct the film and was thinking about casting.


“I was sitting there, going: ‘There is something very strange happening’,” he joked. “Whatever happened, it certainly worked, because I ended up casting both of them.”


Hooper said he took his inspiration mostly from Hugo’s novel rather than any one stage production, and thus saw Crowe’s Javert more as a “deeply honorable” character than a simplistic “bad guy” as portrayed in some productions.


The time also felt right, he said, to bring the story to a larger audience on the big screen.


“There are so many people hurting around the world because of social, economic, inequality and inequity. There is such anger against the system,” he said, “whether it’s the protests on Wall Street or in London at St Paul’s, or the seismic shifts happening in the Middle East.”


“‘Les Miserables’ is the great advocate of the dispossessed,” Hooper said. “It teaches you the way to collective action is through passionate engagement with the people around you. It starts with love for the person next to you.”

Two Reasons Fiscal Cliff Chaos Is Actually Terrific






Immediately after House Speaker John Boehner’s Plan B fell apart Thursday night, Dow futures plummeted and the media freaked out (Huffington Post headline: “END OF THE WORLD“). Boehner and his deputies skulked out of the Capitol, humiliated. His Hail Mary plan to create leverage for Republicans in the fiscal cliff negotiations with Republicans lay in tatters. Soon, his speakership may, too.


But Plan B’s demise doesn’t ensure we’re going over the cliff—it simply narrows the options. And two bits of good news are embedded in the failure. First, if we do go over the cliff, a resolution will arrive sooner than it would have otherwise. That’s because Plan B’s biggest effect, had it passed, would have been to inoculate Republicans against the charge that they blew up the economy to protect “millionaires and billionaires” from tax hikes. Now that they’re vulnerable to that charge, public pressure will be much more intense and likely to elicit a quick concession.






Second, it’s now clear that the only way to avoid the cliff is through a bipartisan bill that can pass the House, probably with substantial Democratic support. The GOP’s self-defeating revolt will shift the center of gravity to the left. Here’s where things get tricky: Boehner has said he won’t bring a bill to the floor unless it has the support of the majority of his caucus. Lost in Thursday night’s disarray was that the overwhelming majority of House Republicans—all but 30 or so of his 241 members—supported Plan B’s tax hike on millionaires. So it’s not impossible to imagine him gaining the support of 121 Republicans (he may need fewer because of vacancies) for a deal that raises taxes on households earning, say, $ 400,000 or $ 500,000, especially if that deal also contains cuts to entitlement programs and removes the dreaded sequester.


But gaining that support is far from a sure thing. It’s what Republicans and Democrats are now frantically trying to gauge. If Boehner can’t get a majority of his caucus on board, then he’ll truly be facing the end of the world—or at least the end of his speakership. The conservatives I polled Thursday night agreed (contra some media chatter) that Plan B’s failure doesn’t threaten Boehner’s job. But they also thought that if Boehner were to pass a cliff bill without a majority of his caucus, he’d be doomed.


In a drama Aaron Sorkin might have scripted, Boehner may soon be faced with the choice of holding firm and hurtling everyone into the abyss or saving the country from chaos by passing a Democratic-friendly bill with only a minority of Republicans—at the cost of his speakership, which (more Sorkin drama) is up for a vote on Jan. 3.


Either way, though, there’s a little more certainty this morning that things will end sooner rather than later. So despite the hyperbole and market turmoil, last night’s vote actually brought some good news.

Kenya police: 28 people killed in clashes






NAIROBI, Kenya (AP) — A police official says 28 people have been killed in clashes between farmers and herders in south-eastern Kenya.


Anthony Kamitu, who is leading police operations to prevent the attacks, said Friday that the Pokomo tribe of farmers raided a village of the Orma herding community, called Kipao, at dawn in the Tana River Delta.






The latest deaths in a tit-for-tat cycle of killings may be related to a redrawing of political boundaries and next year’s general elections, according to the U.N.


At least 110 people were killed in clashes between the Pokomo and Orma in September and October.


Animosity between the two communities over land and water resources has existed for decades.

Nokia, RIM settle old disputes in new patent pact






HELSINKI (AP) — Nokia Corp. and Canadian smartphone rival Research In Motion have agreed on a new patent licensing pact which will end all existing litigation between the two struggling companies, the Finnish firm said Friday.


The agreement includes a “one-time payment and on-going payments, all from RIM to Nokia,” Nokia said, but did not disclose “confidential” terms.






Last month, Nokia sued the Blackberry maker for breach of contract in Britain, the United States and Canada over cellular patents they agreed in 2003. RIM claimed the license — which covered patents on “standards-essential” technologies for mobile devices— should also have covered patents for non-essential parts, but the Arbitration Institute of Stockholm Chamber of Commerce ruled against RIM’s claims.


Major manufacturers of phones and wireless equipment are increasingly turning to patent litigation as they jockey for an edge to expand their share of the rapidly growing smartphone market.


Nokia is among leading patent holders in the wireless industry. It has already received a $ 565 million royalty payment from Apple Inc. to settle long-standing patent disputes and filed claims in the United States and Germany alleging that products from HTC Corp. and Viewsonic Corp. infringe a number of its patents.

“Gangnam Style” in line for UK dictionary inclusion






LONDON (Reuters) – He has the most-watched video in Youtube history, become a pop sensation with a horse-riding dance craze that has swept the world and now Korean singer Psy may cement his place in popular culture with recognition from a British dictionary.


Gangnam Style,” Psy’s signature song, has been chosen along with “fiscal cliff” and “Romneyshambles” as some of Collins Dictionary‘s words of the year.






“We were looking for words that told the story of the year,” said Ian Brookes, the dictionary‘s consultant editor.


“Some words are from events that have been and gone and so are not likely to stick around … but others are probably here to stay.”


Other headline entries centered on American politics.


“Fiscal cliff” has drawn a lot of attention as the deadline for Congress and President Obama to agree on government spending and tax plans draws nearer.


While the term “Romneyshambles” entered the British public’s consciousness after Mitt Romney‘s gaffe-ridden visit to London in July in which he questioned Britain’s readiness to host the Olympics.


The inclusion of “47 percent” on the list after a leaked video showed Romney telling donors that 47 percent of Americans would definitely vote for Obama because of their dependency on the government capped off a bad year for the losing presidential candidate.


Collins received over 7,000 submissions on its online database.


Twelve words of the year – one for each month – were then selected on the basis of the frequency with which they were spoken, how many places they appeared and their longevity in public discourse.


Appearing on the Collins words of the year list is no guarantee of insertion in the next dictionary.


But Gangnam Style stands a very good chance, Brookes said.


“It’s obviously a craze, so there’s the possibility it will go away. But it’s been heard by so many people that I think it’s probably earned the right to go into the dictionary.”


Other words of the year include “mummy porn” after the popularity of the “Fifty Shades of Grey” books, and “superstorm” after Superstorm Sandy wreaked havoc along the east coast of America in October.

Conditional approval for Minn. health exchange






ST. PAUL, Minn. (AP) — U.S. Health and Human Services Secretary Kathleen Sebelius says Minnesota has reached a milestone in its effort to establish a health insurance exchange.


Sebelius notified Gov. Mark Dayton Thursday that the state has been granted conditional approval to operate its health insurance marketplace in 2014.






Nine other states and the District of Columbia have been given similar approval. Sebelius says the Centers for Medicare & Medicaid Services granted approval based on the state’s progress to date and its expected progress. The approval is contingent on the state’s ability to comply with regulations and meet the anticipated progress, among other things.


The health insurance marketplace will give more than a million state residents and small businesses an easy way to compare and buy private health insurance plans, using subsidies if they qualify.

Economic impact of Canada retail sales jump seen small






OTTAWA (Reuters) – Canada retail sales in October jumped by a stronger-than-expected 0.7 percent from September to hit a record, but analysts said the figures were less impressive than they seemed and would not do much to boost recent sluggish economic growth.


Statistics Canada said on Thursday that retail sales in October reached C$ 39.45 billion ($ 39.85 billion), the third consecutive all-time high. Sales have now grown for four straight months.






But analysts, who had expected a month-over-month increase of 0.2 percent, noted that in volume terms sales were only up by 0.3 percent.


This, they predicted, would not have a major effect on October gross domestic product data due out on Friday. The consensus forecast is for a 0.1 percent increase.


“It’s volume that matters to GDP such that while the (October) gain was positive, it will translate into GDP much less powerfully than the headline would suggest,” Scotiabank economists Derek Holt and Dov Zigler said in a note to clients.


Canada’s economy grew at a sluggish 0.6 percent pace, annualized, in the third quarter. Although the Bank of Canada is predicting fourth-quarter growth of 2.5 percent, annualized, that looks to be too optimistic given exporters’ problems with weak markets and the strong Canadian dollar.


The retail sales data helped push the Canadian dollar up to a session high of C$ 0.9875 versus the U.S. dollar, or $ 1.0127, compared with C$ 0.9890, or $ 1.0111, before the release. It later slipped back and at 10:05 a.m. (1505 GMT) was trading at C$ 0.9893, or $ 1.0111.


In October, gains were reported in eight of 11 subsectors, representing 92 percent of retail trade.


On annualized terms, fourth-quarter retail sales growth so far is an anemic 0.6 percent, compared with the 2.2 percent rise recorded in the third quarter.


Benjamin Reitzes, senior economist at BMO Capital Markets, also noted sales growth from October 2011 was just 1.7 percent, matching June’s figure and the second-lowest since Canada emerged from recession.


“Underlying sales continue to slow, which has been the story for much of the past year, as modest job growth, warnings about over-indebtedness and the allure of cross-border shopping weigh on retailers,” he said in a note to clients.


Sales at motor vehicles and parts dealers grew by 1.6 percent on the back of a 1.6 percent increase in sales by new car dealers, who posted a fifth consecutive monthly gain. Sales at gasoline stations also advanced by 1.6 percent.


Food and beverage store sales were up by 0.5 percent. Furniture and home furnishings store sales fell by 2.0 percent while electronics and appliance stores recorded a decline of 1.6 percent.

State Department security chief leaves post over Benghazi






WASHINGTON (Reuters) – The U.S. State Department said on Wednesday its security chief had resigned from his post and three other officials had been relieved of their duties following a scathing official inquiry into the September 11 attack on the U.S. mission in Benghazi.


Eric Boswell has resigned effective immediately as assistant secretary of state for diplomatic security, State Department spokeswoman Victoria Nuland said in a terse statement. A second official, speaking on condition of anonymity, said Boswell had not left the department entirely and remained a career official.






Nuland said that Boswell, and the three other officials, had all been put on administrative leave “pending further action.”


An official panel that investigated the incident concluded that the Benghazi mission was completely unprepared to deal with the attack, which killed U.S. Ambassador Christopher Stevens and three other Americans.


The unclassified version of the report, which was released on Tuesday, cited “leadership and management” deficiencies, poor coordination among officials and “real confusion” in Washington and in the field over who had the authority to make decisions on policy and security concerns.


“The ARB identified the performance of four officials, three in the Bureau of the Diplomatic Security and one in the Bureau of (Near Eastern) Affairs,” Nuland said in her statement, referring to the panel known as an Accountability Review Board.


Secretary of State Hillary Clinton accepted Boswell’s decision to resign effective immediately, the spokeswoman said.


Earlier, a U.S. official who spoke on condition of anonymity said Boswell, one of his deputies, Charlene Lamb, and a third unnamed official has been asked to resign. The Associated Press first reported that three officials had resigned.


PANEL STOPS SHORT OF BLAMING CLINTON


The Benghazi incident appeared likely to tarnish Clinton’s four-year tenure as secretary of state but the report did not fault her specifically and the officials who led the review stopped short of blaming her.


“We did conclude that certain State Department bureau-level senior officials in critical positions of authority and responsibility in Washington demonstrated a lack of leadership and management ability appropriate for senior ranks,” retired Admiral Michael Mullen, one of the leaders of the inquiry, told reporters on Wednesday.


The panel’s chair, retired Ambassador Thomas Pickering, said it had determined that responsibility for security shortcomings in Benghazi belonged at levels lower than Clinton’s office.


“We fixed (responsibility) at the assistant secretary level, which is, in our view, the appropriate place to look for where the decision-making in fact takes place, where – if you like – the rubber hits the road,” Pickering said after closed-door meetings with congressional committees.


The panel’s report and the comments by its two lead authors suggested that Clinton, who accepted responsibility for the incident in a television interview about a month after the Benghazi attack, would not be held personally culpable.


Pickering and Mullen spoke to the media after briefing members of the House of Representatives Foreign Affairs Committee and Senate Foreign Relations Committee behind closed doors on classified elements of their report.


Clinton had been expected to appear at an open hearing on Benghazi on Thursday, but is recuperating after suffering a concussion, dehydration and a stomach bug last week. She will instead be represented by her two top deputies.


Clinton, who intends to step down in January, said in a letter accompanying the review that she would adopt all of its recommendations, which include stepping up security staffing and requesting more money to fortify U.S. facilities.


The National Defense Authorization Act for 2013, which is expected to go to Congress for final approval this week, includes a measure directing the Pentagon to increase the Marine Corps presence at diplomatic facilities by up to 1,000 Marines.


Some Capitol Hill Republicans who had criticized the Obama administration’s handling of the Benghazi attacks said they were impressed by the report.


“It was very thorough,” said Senator Johnny Isakson. Senator John Barrasso said: “It was very, very critical of major failures at the State Department at very high levels.” Both spoke after the closed-door briefing.


Others, however, took a harsher line and called for Clinton to testify as soon as she is able.


“The report makes clear the massive failure of the State Department at all levels, including senior leadership, to take action to protect our government employees abroad,” Representative Mike Rogers, the Republican chairman of the House Intelligence Committee, said in a statement.


Senator Bob Corker, who will be the top Republican on the Senate Foreign Relations Committee when the new Congress is seated early next year, said Clinton should testify about Benghazi before her replacement is confirmed by the Senate.


Republicans have focused much of their firepower on U.S. Ambassador to the United Nations Susan Rice, who appeared on TV talk shows after the attack and suggested it was the result of a spontaneous protest rather than a premeditated attack.


The report concluded that there was no such protest.


Rice, widely seen as President Barack Obama’s top pick to succeed Clinton, withdrew her name from consideration last week.

Nintendo’s amazing triumph in Japan may doom the company internationally






According to Japanese gaming bible Famitsu, Nintendo (NTDOY) 3DS sold 333,000 units in the week ending December 16, while Sony’s (SNE) PS Vita limped along at 13,000 units, the new Wii U did an okay 130,000 units and the PlayStation 3 managed to sell 46,000 units.  The utter hardware domination of the 3DS is reshaping the Japanese software market. Franchises that were thought to be fading have been revitalized in their portable versions. The 3DS version of the ancient Animal Crossing series, famed for being the game where nothing happens, hit a staggering 1.7 million units last week in Japan. Inazuma Eleven sold 170,000 units in its launch week, up from 140,000 units its DS version managed in 2011.

Nintendo’s portable console 3DS had a muted start in its home market in the spring of 2011. Many thought that Sony would have a fair shot at competing with Nintendo once Playstation Vita launched at the end of 2011. But once Nintendo executed an aggressive price cut for 3DS in the summer of 2011 and then launched a large-screen version of the console in mid-2012, the gadget has grown into a Godzilla in Japan, demolishing both Sony Vita and aging tabletop console competition.

3DS is doing well also in America, where its lifetime sales are moving close to the 6 million unit mark this holiday season. According to NPD, the 3DS sales in the United States topped 500,000 units in November. That’s a decent number, though far from the torrid volume the portable is racking up in its home market. The U.S. November video game software chart was dominated by massive home console juggernauts: new installments of Call of Duty, Halo and Assassin’s Creed franchises shifted more than 13 million units in retail. At the same time, the Japanese software chart remains in a ’90s time warp, dominated by Nintendo’s musty masterpieces: Super Mario Brothers, Pokemon, Animal Crossing, etc.


Japanese and American tastes have always been different. But what we are witnessing now is a particularly fascinating divergence. American consumers are spending more of their time and money on smartphone and tablet games, while console game spending is increasingly focusing on massive, graphically stunning blockbuster titles on Xbox360 and PS3. The casual gamers are shifting to mobile games, while hardcore gamers remain attracted to sprawling epics on home consoles. The overall video game spending in America keeps declining month after month, as casual titles and mid-list games slide. But the Triple A whales like the Call of Duty series are doing better than ever.


In Japan, Nintendo has been able to battle back iPhone and Android game invasion with a nostalgic series of portable games that basically recycle the biggest hits of ’80s and early ’90s. Mario, Pokemons and other portable heroes are slowly losing their grip on U.S. and European consumers. But in Japan, some form of national nostalgia is keeping Nintendo on track.


The problem here is that the Japanese success of the 3DS may now be convincing Nintendo that it does not have to reconsider its business strategy. The smartphone and tablet game spending continues growing explosively across the world. Unlike console games, mobile game sales in China are legal. The global gaming spending is shifting towards new hardware platforms even as console mammoths like Halo still reign in America. At this critical juncture, Nintendo has managed to cocoon its home market in a web of nostalgia, turning the 3DS console and its Eighties left-over franchises into epic bestsellers yet again.


This means that there is no sense of urgency to push Nintendo into rethinking its long-term plans. The company may continue simply ignoring the smartphone and tablet challenge, designing new portable consoles and the 28th Mario game to support it. Twenty years ago, Japan’s insularity doomed its chances to succeed in the mobile phone business. And now the idiosyncratic nature of Japan may be leading its biggest entertainment industry success astray.

A Minute With: Jessica Chastain on “Zero Dark Thirty”






NEW YORK (Reuters) – Jessica Chastain carries the weight of starring in one of the year’s most anticipated films, “Zero Dark Thirty,” about the decade-long hunt and eventual killing of Osama bin Laden.


Critics say Chastain pulls it off seamlessly as “Maya,” based on a real-life CIA agent who played a major role in tracking down bin Laden at his hideout in Pakistan.






As the film opens in limited U.S. release on Wednesday, Chastain, who is tipped as a likely best actress Oscar nominee for the role, talked to Reuters about playing a character she could not meet and why the film is an important look at America’s role in a dark war.


Q. What did you think when you saw this film finished?


A. “It is a tough one for me to watch, because there is so much responsibility with playing this woman. I find her to be incredible. And I didn’t want to change her story or make her a Hollywood version, with a lot of makeup. I didn’t want to trivialize what she did … I want her to like it, but I don’t know if she will ever see it.”


Q. How did you play someone you had never met?


A. “There was three months of working with (screenplay writer) Mark Boal, doing research, reading lists and talking to people. And then anything I could not solve through research, like what is her favorite candy – ’cause when we are all overseas we have something we do when we are homesick – I had to answer that question myself.”


Q. Boal hasn’t gone into too much detail about her?


A. “We have to protect her because she is an undercover CIA operative, still working.”


Q. What else did you know about her?


A. “When we finished the movie, when the Navy Seal book ‘No Easy Day’ came out. I raced to go read it, because I was like, ‘I need to know if my character is in the book!’ And they talk about Jen, the young CIA girl. Well, everything matched up. She was the only one that said 100 percent ‘he is there.’… They talked about how she had been on it close to a decade and they were only on it for 40 minutes. They said she was crying on the airplane afterwards.”


Q. During filming, were you ever worried about your safety, that the film might be misconstrued?


A. “As an actor you always worry about that. Because you think, maybe someone will see a film and they won’t understand the difference between acting and reality. The good thing is, what (director Kathryn Bigelow) and Mark have done, is that they have not made a propaganda film. They tried to make it as authentic as possible and respectful of the actual historical event as they could. That includes showing the intense interrogation techniques that were used. The end of the film – it’s not a lot of fist pumping and saying, ‘Here is our journey over 10 years and it was so difficult and we finally did it.’ It ends actually on a very different note.”


Q. Can you elaborate on that?


A. “Well, for me the whole thing is about the arc of this woman. She shows up in the beginning and she is wearing her best suit. She thinks she knows what she is in for, and she is completely out of her element. But over the 10 years, this woman, who has been trained to be unemotional and analytically precise … we see her struggling to keep it contained for 10 years and as she descends down the rabbit hole of the world she is in.


“So finally at the end when she is asked, ‘Where do you want to go?’ there is no way to answer that question. … She has no idea where she belongs, now that this is done. But not only does it speak in terms of that, but the movie ends with that question – where do you want to go? Where do we go now as a country? Where do we go as a society? It is not a movie that ends with an answer, and I find that powerful.”


Q. How did you cope with filming the torture scenes?


A. “We filmed in a real Jordanian prison, in the middle of nowhere. The environment wasn’t great, especially as a woman.


“They had a lot of trust between the actors, nothing was dangerous or unsafe. There was a lot of discussion to make sure that we weren’t doing something that was going to be salacious. They just wanted it to be accurate.


“I know I am playing a character who has trained to be unemotional. But I have spent my entire life allowing myself to be emotional, and allowing myself to feel everything. … There was actually one day that we were doing a scene, and I said, ‘I am sorry’ and I just had to walk away, and I just started crying … it was a very intense experience.”


Q. You are a top chance for Oscar nomination. Would that be more or less rewarding for this role?


A. “Because she is still an active member of the CIA and undercover, she can’t take credit for what she’s done. … And by making this film, it is my idea as a way of thanking her. It would be very emotional because of that.”


Q. You compare your character to getting lost down a CIA rabbit hole. What about your own dizzying rise as an actress?


A. “That’s a good question. I do think that next year I need to go somewhere for a month and be in a room by myself and be like, ‘Ok, what now Jessica?’ But I am nowhere near where she was at the end of this mission.”

How Can Professional Santas Avoid the Flu?






A lot of kids must sit on Santa’s lap before he can hop in his sleigh on Christmas Eve, but Santa has to be extra careful during flu season if he wants to stay healthy into the New Year.


John Sullivan, a professional Santa Claus in Chicago, said he never turns down a child, even if the child’s nose is runny.






“I’ll see him. I’ll talk to him,” Sullivan said. “That’s just a risk that frankly comes with the job … Santa can’t go around wearing a surgical mask!”


Since children actually exhale more flu virus than adults because their immune systems are immature, Santa and other people who work with children are at greater risk for coming down with the flu, said Dr. William Schaffner, chairman of preventative medicine at Vanderbilt University in Tennessee.


“Of course, Santa is leaning over the child and listening carefully. He’s in the breathing zone of all these children,” Schaffner said. “They come into very close contact with a myriad of children, and children are the great distributor of respiratory viruses.”


Not only do children exhale more of the virus in each breath than adults do, but they also exhale it longer: 24 hours before they start feeling sick until after they feel better.


“It is likely because children are experiencing these viruses probably for the first time, and that their immune systems are not trained to combat the viruses and shut down the virus production mechanism quickly,” Schaffner said.


Schaffner said it’s important for professional Santa performers like Sullivan to get their flu shots, keep up their fluids and get enough sleep and exercise during the holiday season so that their bodies can fight the flu if they come in contact with it.


Sullivan has been Santa Claus every holiday season for more than two decades, and he never misses a flu shot, he said. He started in malls and now does private events at homes, offices and daycares.


“A lot of times when you pick up a baby, you can feel in their lungs that there’s congestion,” he said. “I’ll tell the parent the baby has cold … Frankly, if I’m Santa, I never reject a child.”


He said he’s gotten mild colds, but nothing serious, and he’s always mindful to avoid getting other people sick if he’s not feeling well.


Near Orlando, Greg Thompson runs The Santa Company, which has seven Santas, including Thompson himself, who has been dressing as Santa since he was 14. (“I’d discovered Santa’s secret, so I decided I wanted to be him.”) That first year, Thompson was 129 lbs., so his grandmother helped him stuff a pillow under his puffy jacket to complete the costume.


Although Thompson’s size may have been a problem, the flu wasn’t, he said. In fact, The Santa Company hasn’t had anyone call out sick since it was founded in 1999.


“We have not had it happen yet – knock on wood – but if someone were to come in and say, ‘Greg, I’m just sick and I can’t come in,’ we’d make sure to have a Santa for him,” Thompson said. “We’re more concerned about people bringing their kids to us. If a kid is obviously sick, you can look at him and tell, sometimes.”


Of the 80 appearances The Santa Company does each year, Thompson does about a quarter of them. When a child approaches Thompson-as-Santa with a runny nose and red eyes, Thompson said he will ask the child to sit down in front of him instead of on his lap.


“I’ll be happy to speak with him,” he said.


Thompson added that his Santas always wear clean gloves as part of the classic red suit with white trim, and they cough only into their elbows.


But Schaffner said gloves can quickly become contaminated, and probably don’t offer much protection against the virus as Santa touches a child and strokes his beard or touches his nose. Even surgeons are taught to wash their hands after they remove gloves, he said.


“They are at risk. There’s no doubt about it,” Schaffner said. “But maybe Santa’s beard and mustache can act like a filter and keep the virus out,” he joked with a laugh.


Santa is magical, after all.

Nissan to invest £250m in the UK












Nissan says it is investing £250m in Sunderland to make a small luxury car, creating “hundreds of jobs” in the UK.


“The Sunderland factory is very competitive,” said Nissan’s chief performance officer Colin Dodge.


The Infiniti model was penned by Nissan’s design team in London and engineered at its technical centre in Bedfordshire.


Their brief was to appeal to buyers in Europe, where the marque’s sales are weak.


Business Secretary Vince Cable visited the Sunderland plant on Wednesday for the investment announcement.


“Today’s news is a strong endorsement of the quality of Britain’s car industry, which is creating jobs, taking on apprentices and contributing to building a stronger economy,” he said.


“The auto sector is living up to being one of the great success stories of our industrial strategy and a testimony to government and private sector working together in close partnership.”


‘Pivotal car’

Mr Dodge said it was too early to be specific about how many jobs would be created as a result of the fresh investment.


It was suggested, however, that it could be about 280 directly at the factory, with a further 700 or so created with suppliers.


However, to make space for the Infiniti, a previously announced investment of £127m to build a hatchback, involving some 125 jobs, will now be moved from Sunderland to another Nissan factory in Europe, for instance in Spain or Russia, an Infiniti spokesman said.


The Infiniti investment will be made during the next two years and the new Infiniti will start rolling off the assembly line in 2015, Mr Dodge said.


Nissan said it would produce up to 60,000 Infiniti cars per year.


The new car has not yet been named, beyond an announcement that it will be called something starting with Q followed by a digit and ending with 0, but it will be based on the Ethera concept vehicle that was displayed at the Geneva motor show in 2011.


“It is a pivotal car for Europe,” Mr Dodge said.


Ambitious target


Infiniti has made little headway since it was first launched in Europe in 2008 with a series of large, thirsty cars with powerful V6 and V8 petrol engines.


“The Infiniti brand has been very American-centric for years,” Mr Dodge said, “but the new, smaller model is the size of car for Europe rather than for the US.”


Infiniti has set itself an ambitious sales target in Europe of 100,000 cars by 2016, compared with 16,700 cars sold in 2011.


Between a third and half the sales of the new Infiniti are expected to come in Europe, said Mr Dodge.


The car will be the first Infiniti to be offered with a diesel engine, an option seen as crucial to win over European drivers, Mr Dodge said, though he declined to reveal further details about the engine options for the car.


The Ethera concept was a petrol-electric hybrid with a 2.5-litre four-cylinder engine. Nissan is developing engines jointly with Mercedes-owner Daimler, it works closely with alliance partner Renault, and in March this year it unveiled a high performance petrol-electric hybrid model, the Emergenc-e, that will use a three-cylinder petrol engine made by Hethel, Norfolk-based Lotus.


Efficient factory


Sunderland was awarded the model thanks to its reputation for efficiency, both in terms of quality and cost as well as ability to deliver, said Mr Dodge, who worked at the plant from 1984 until 2007 before he was promoted and moved to the Nissan headquarters in Japan.


Nissan used to claim that its Sunderland plant, which currently employs more than 6,000 people, was the most efficient car factory in Europe, though these days it tends not to mention this.


“But it is,” said Mr Dodge. “We just don’t keep chest-beating about it year in, year out.”


Nissan said Sunderland is on schedule to become the first car factory in the UK to have produced more than 500,000 cars in one calendar year. “Even during British Leyland times, they didn’t do that,” said Mr Bolt.


Global production


The decision to produce the new Infiniti outside Japan was based on a number of factors.


“Historically, we’ve made Infiniti in Japan,” said Mr Dodge, though in recent years, he explained, the yen has been very strong, thus making it difficult to make money from cars exported from Japan.


In response, the carmaker is shifting production to the UK, the US and China.


It is “heartbreaking” for Nissan’s Japanese staff to see production moved out of the country, Mr Dodge said.


“They can make cars as well as anybody,” he said, “but they’re at a significant disadvantage when compared with rivals selling cars in dollars, euros or pounds.”


But the strong yen is not the only reason why Nissan makes ever more cars abroad.


Investment and production in growth markets around the world would probably continue even if the yen was to fall in value, as it is expected to do under the country’s next prime minister, Shinzo Abe.


“If you’ve got a manufacturing base and a supply base set up, it is best to produce and sell in one currency,” said Mr Dodge.

Canada serial killer inquiry finds “systemic bias” by police






(Reuters) – Police made critical errors in pursuing Canadian serial killer Robert Pickton partly because of “systemic bias” against his victims, sex trade workers from a rough Vancouver neighborhood, according to the final report from a public inquiry released on Monday.


Commissioner Wally Oppal was asked by the British Columbia government to investigate, in effect, why Pickton was not caught sooner. Women disappeared from the Downtown Eastside neighborhood for more than a decade before the pig farmer’s 2002 arrest.






“The investigations of missing and murdered women were characterized by blatant police failures, and by public indifference,” Oppal said at a press conference in Vancouver that was frequently interrupted by protesters.


Pickton was convicted of six murders, but prosecutors believe he killed many more – 20 other charges were stayed after he received the maximum possible sentence.


Oppal outlined a string of police errors, from failing to take proper reports when women went missing and communicate adequately with families, to ineffective coordination across jurisdictions. He called his more than 1,200-page report, which is based on eight months of hearings, “Forsaken”.


“After reviewing the evidence of the investigations, I have come to the conclusion that there was systemic bias by the police,” he said.


Oppal recommended that the provincial government establish a compensation fund for the children of the victims and consider creating a regional police force for Vancouver, instead of the patchwork of jurisdictions currently in place.


After Oppal’s announcement, B.C. Minister of Justice Shirley Bond wiped away tears as she spoke to victims’ families.


“I want you to know that, however inadequate these words sound, we are sorry for your loss,” she said. “We will work hard to prevent these circumstances from being repeated in our province.”


She announced the appointment of a former lieutenant governor, Steven Point, to serve as the report’s “champion”, guiding implementation. Bond said the government would immediately give new funding to WISH, a drop-in center for women who work in the Downtown Eastside’s sex trade.


POLICE RESPOND


The Vancouver Police Department said in a short statement that it is committed to learning from its mistakes and will study the report.


“We know that nothing can ever truly heal the wounds of grief and loss but if we can, we want to assure the families that the Vancouver Police Department deeply regrets anything we did that may have delayed the eventual solving of these murders,” it said.


Deputy Commissioner Craig Callens, who commands the Royal Canadian Mounted Police in British Columbia, said in a statement that his force will review the report.


Oppal said many individual police officers were diligent, and he commended several by name. But he said that as a system, the authorities failed because of bias against Pickton’s victims, many of whom were poor and addicted to drugs.


“Would the reaction of the police and the public have been any different if the missing women had come from Vancouver’s (more affluent) west side? The answer is obvious,” he said.


Aboriginal women were overrepresented among the victims, and Oppal repeatedly referred to the broader “marginalization” of aboriginal people in Canada.


“There has to be community responsibility for what has taken place,” he said, highlighting poverty and the conditions on the Downtown Eastside. “The social reality is that racism and gender bias are prevalent within Canadian society, and we must do something to eradicate those.”


Victims’ families and activists were on hand for Oppal’s press conference, and he stopped speaking several times as audience members shouted criticism, chanted and played drums.


The provincial government did not offer funding to a number of community organizations that said they needed support to participate in the lengthy and complex inquiry. In protest, other groups boycotted the process.


In November, several organizations, including the B.C. Civil Liberties Association, released their own report, criticizing the inquiry for, among other things, excluding too many aboriginal women, sex trade workers and drug users.


Bond, the justice minister, said she did not regret the decision not to fund those groups, but said she saw them participating in the future. “I think going forward this is room for us to include other voices.” (Reporting by Allison Martell; Editing by Eric Beech)

Shooting renews argument over video-game violence






WASHINGTON (AP) — In the days since the massacre at Sandy Hook Elementary School in Newtown, Conn., a shell-shocked nation has looked for reasons. The list of culprits include easy access to guns, a strained mental-health system and the “culture of violence” — the entertainment industry’s embrace of violence in movies, TV shows and, especially, video games.


“The violence in the entertainment culture — particularly, with the extraordinary realism to video games, movies now, et cetera — does cause vulnerable young men to be more violent,” Sen. Joe Lieberman, I-Conn., said.






“There might well be some direct connection between people who have some mental instability and when they go over the edge — they transport themselves, they become part of one of those video games,” said Gov. John Hickenlooper of Colorado, where 12 people were killed in a movie theater shooting in July.


White House adviser David Axelrod tweeted, “But shouldn’t we also quit marketing murder as a game?”


And Donald Trump weighed in, tweeting, “Video game violence & glorification must be stopped — it is creating monsters!”


There have been unconfirmed media reports that 20-year-old Newtown shooter Adam Lanza enjoyed a range of video games, from the bloody “Call of Duty” series to the innocuous “Dance Dance Revolution.” But the same could be said for about 80 percent of Americans in Lanza’s age group, according to the Pew Internet and American Life Project. Law enforcement officials haven’t made any connection between Lanza’s possible motives and his interest in games.


The video game industry has been mostly silent since Friday’s attack, in which 20 children and six adults were killed. The Entertainment Software Association, which represents game publishers in Washington, has yet to respond to politicians’ criticisms. Hal Halpin, president of the nonprofit Entertainment Consumers Association, said, “I’d simply and respectfully point to the lack of evidence to support any causal link.”


It’s unlikely that lawmakers will pursue legislation to regulate the sales of video games; such efforts were rejected again and again in a series of court cases over the last decade. Indeed, the industry seemed to have moved beyond the entire issue last year, when the Supreme Court revoked a California law criminalizing the sale of violent games to minors.


The Supreme Court decision focused on First Amendment concerns; in the majority opinion, Justice Antonin Scalia wrote that games “are as much entitled to the protection of free speech as the best of literature.” Scalia also agreed with the ESA’s argument that researchers haven’t established a link between media violence and real-life violence. “Psychological studies purporting to show a connection between exposure to violent video games and harmful effects on children do not prove that such exposure causes minors to act aggressively,” Scalia wrote.


Still, that doesn’t make games impervious to criticism, or even some soul-searching within the gaming community. At this year’s E3 — the Electronic Entertainment Expo, the industry’s largest U.S. gathering — some attendees were stunned by the intensity of violence on display. A demo for Sony’s “The Last of Us” ended with a villain taking a shotgun blast to the face. A scene from Ubisoft’s “Splinter Cell: Blacklist” showed the hero torturing an enemy. A trailer for Square Enix’s “Hitman: Absolution” showed the protagonist slaughtering a team of lingerie-clad assassins disguised as nuns.


“The ultraviolence has to stop,” designer Warren Spector told the GamesIndustry website after E3. “I do believe that we are fetishizing violence, and now in some cases actually combining it with an adolescent approach to sexuality. I just think it’s in bad taste. Ultimately I think it will cause us trouble.”


“The violence of these games can be off-putting,” Brian Crecente, news editor for the gaming website Polygon, said Monday. “The video-game industry is wrestling with the same issues as movies and TV. There’s this tension between violent games that sell really well and games like ‘Journey,’ a beautiful, artistic creation that was well received by critics but didn’t sell much.”


During November, typically the peak month for pre-holiday game releases, the two best sellers were the military shooters “Call of Duty: Black Ops II,” from Activision, and “Halo 4,” from Microsoft. But even with the dominance of the genre, Crecente said, “There has been a feeling that some of the sameness of war games is grating on people.”


Critic John Peter Grant said, “I’ve also sensed a growing degree of fatigue with ultra-violent games, but not necessarily because of the violence per se.”


The problem, Grant said, “is that violence as a mechanic gets old really fast. Games are amazing possibility spaces! And if the chief way I can interact with them is by destroying and killing? That seems like such a waste of potential.”


There are some hints of a sneaking self-awareness creeping into the gaming community. One gamer — Antwand Pearman, editor of the website GamerFitNation — has called for other players to join in a “Day of Cease-Fire for Online Shooters” this Friday, one week after the massacre.


“We are simply making a statement,” Pearman said, “that we as gamers are not going to sit back and ignore the lives that were lost.”

HBO making “Game of Thrones”-themed beer






LOS ANGELES (TheWrap.com) – Winter is coming – and so is a new line of beers based on HBO‘s fantasy dramaGame of Thrones.” Presumably, all will boast a full, robust head, perhaps resting on top of a spike.


HBO is teaming with Cooperstown, N.Y. brewery Ommegang for a line of brews centered around the series, the New York Times reports. The first beer, Iron Throne Blonde Ale, is slated to go on sale in March, in time for the March 31 premiere of the show’s third season.






It sounds like the perfect libation for watching the premiere from the comfort of your $ 30,000 Iron Throne replica.


A second “GoT”-themed beer will go on sale in fall 2013, with two more varieties expected to go on sale in conjunction with new seasons of the series.

Merck, GE to collaborate on Alzheimer’s drug development






(Reuters) – Merck & Co and General Electric Co‘s healthcare unit have agreed to collaborate on an experimental drug for Alzheimer’s disease, the companies said on Tuesday.


GE Healthcare will supply Flutemetamol, an investigational imaging agent, to Merck for use with its experimental Alzheimer’s disease drug MK-8931.






The companies hope GE’s imaging agent will help identify patients who might benefit from a therapy such as Merck’s, which targets beta amyloid, a protein that can clump together and form plaques in the brain. Such plaques have been found in the brains of patients with Alzheimer’s disease.


MK-8931 is Merck’s lead Alzheimer’s drug candidate and is designed to modify progression of the disease as well as improve symptoms. Alzheimer’s robs patients of their memory and can cause other cognitive disturbances.


Based on promising results from an early-stage clinical trial of MK-8931, Merck plans to move forward with a larger trial, called EPOCH, at multiple sites around the world.


Flutemetamol is a positron emission tomography (PET) imaging agent that has been able, in clinical trials, to detect beta amyloid in the brain.


GE Healthcare will supply Flutemetamol to help select patients for clinical trials and evaluate the agent as a companion diagnostic tool. Financial and other terms of the agreement between the companies were not disclosed.
